DMCA Policy

EAA Labs respects the intellectual property rights of others and expects users of www.eaalabs.com (the “Site”) to do the same. This policy explains how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

1. Reporting Copyright Infringement

If you believe that content on our Site infringes your copyright, you may submit a notification to our designated agent. To be effective, your notice must include the following, as required by 17 U.S.C. § 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material claimed to be infringing, and information reasonably sufficient to allow us to locate it on the Site (e.g., a URL)
4. Your contact information, including your address, telephone number, and email address
5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf

3. Counter-Notification

If you believe material you posted or that relates to you was removed or disabled in error, you may submit a counter-notification to our designated agent that includes:

1. Your physical or electronic signature
2. Identification of the material that was removed and its location before removal
3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the US, an applicable jurisdiction) and will accept service of process from the party who submitted the original complaint

4. Our Response Process

Upon receiving a valid DMCA notice, we will:

• Review the claim and, where appropriate, remove or disable access to the allegedly infringing material
• Notify the party who posted or is associated with the material, where applicable
• Process valid counter-notifications in accordance with the DMCA, which may include restoring the material after a required waiting period unless the original complainant files a court action

5. Repeat Infringers

We reserve the right to terminate access to the Site for users who are determined to be repeat infringers of copyright.

6. Good Faith Notices Only

Please note that under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation in a notification or counter-notification may be liable for damages. Please ensure your claim is accurate before submitting.

7. Changes to This Policy

We may update this DMCA Policy from time to time. Changes will be posted on this page with an updated “Last updated” date.
